KOTA KINABALU: A single father who stole 18 packets of Milo to put food on the table, was jailed three months by the Magistrate's Court today.
Magistrate Lovely Natasha Charles meted out the sentence on Yassin Muhammad Nur, 31, after he admitted his wrongdoing.
Yassin, who is unemployed had committed the offence on April 9, at 2.30pm, at KWC The Grocer, here.
The charge, under Section 380 of the Penal Code provides imprisonment of up to 10 years, and a fine, upon conviction.
The facts of the case stated that Yassin exited the grocery store without making any payment. The store staff was trying to stop the accused, but the latter threatened to harm anyone who approached him.
The store manager then contacted the police which led to the arrest of the accused and the seizure of the stolen items at a stall in Medan Selera, Kg. Air, Asia City.
Further investigations also revealed that the accused stole the Milo to be sold to get money.
During mitigation, National Legal Aid Foundation (YBGK) counsel Lim Ming Zoong who represented Yassin asked for leniency saying among others that the desperate accused had committed the crime to get money.
Lim said, the divorcee who was a first-time offender has no job and has a nine-year-old child to look after.
Prosecuting officer Inspector Kelvan Elson Maik urged for an appropriate sentence.
